Update on Lawsuit: Hearing on Wednesday

Dane County Judge Maryann Sumi tomorrow will decide whether Attorney General Van Hollen may act as the plaintiff in his lawsuit against the Government Accountability Board (GAB).  Lester Pines, the lawyer for the GAB, has filed a motion to disqualify Van Hollen, based on the fact that he is representing the GAB in two other suits.  Van Hollen has responded that he has no intention of recusing himself.  If Judge Sumi rejects Mr. Pines' motion to disqualify the Attorney General, then she will take up motions to intervene in the lawsuit from the Democratic Party and a labor coalition.  The Green Bay Press Gazette ran an editorial Sunday stating that "the Attorney General needs to step away" because of an apparent conflict of interest due to his role in the McCain campaign.  The hearing will be at 1:30, Wednesday, Sept. 24, in the Dane County Courthouse.
