League and Others File Brief in AG Lawsuit

The League of Women Voters of Wisconsin Education Fund joined other voting rights organizations October 6 in filing a "friend of the court" brief in Attorney General Van Hollen's lawsuit against the state Government Accountability Board (GAB) regarding the state's compliance with the 2002 Help America Vote Act (HAVA).  The brief lays out a legal argument as to why Van Hollen’s attempts to purge voter rolls and retroactively cross check voter identification with existing state databases before the November 4 election goes beyond the intended scope of HAVA.  Joining the League on the amicus curiae brief are: the Brennan Center for Justice at the NYU School of Law; the Lawyers Committee for Civil Rights Under Law; the Campaign Legal Center; the Voting Rights Project of the American Civil Liberties Union; the American Civil Liberties Union of Wisconsin Foundation, Inc.; Fair Elections Wisconsin; and Ohio State University law professor Daniel P. Tokaji.  Read more:  icon motion 10/06/2008   icon amicus brief 10/06/2008

Last week the Milwaukee Chapter of the NAACP and the Milwaukee Teachers' Education Association asked Judge Maryann Sumi to dismiss the suit on the grounds that it could keep thousands of African American people and other minorities from casting a ballot on November 4.  Judge Sumi said last Thursday she will rule October 23 on this motion and others that may come in.
